Terms of use
These terms are the agreement between you and the developer of NeroPlant (“we”, “us”) for your use of the NeroPlant mobile app and this website. By creating an account or using the app, you accept them. If you do not accept them, please do not use NeroPlant.
1. What NeroPlant is
NeroPlant is a houseplant-care app. It identifies plants from a photograph, gives an opinion on a plant’s health from a photograph, keeps a care schedule you tick off, organises your plants by room, and includes an AI assistant called Sprout that answers plant questions. It is a helper for hobby gardeners — nothing more.
The app is currently free of charge. There are no in-app purchases, no subscriptions and no advertising.
2. Your account
You need an account to use NeroPlant. You may create one with an email address and password, or with Google sign-in. You agree to give accurate details, to keep your password to yourself, and to tell us at [email protected] if you think someone else has got into your account. You are responsible for what happens under your account.
You must be at least 13 years old to use NeroPlant. The app is intended for adults and is not directed at children; if you are under the age of majority where you live, use it only with a parent or guardian’s permission.
One person, one account. Do not share your login or let anyone else use your account.
3. Acceptable use
Use NeroPlant for looking after plants. You agree not to:
- break the law with it, or use it to infringe anyone’s rights;
- upload photographs you do not have the right to upload, or photographs of other people without their agreement — the camera features are for plants;
- upload or send anything unlawful, abusive, hateful, sexual or deliberately harmful;
- attempt to get the Sprout assistant to produce content that is unlawful or harmful, or to use it as a general-purpose chatbot unrelated to plants;
- reverse-engineer, decompile or tamper with the app, or try to break into our servers or another user’s account;
- scrape, bulk-download or automate the app or its API, overload it, or resell access to it;
- work around any rate limit, security measure or usage restriction we put in place.
We may limit the number of identification, diagnosis or assistant requests an account can make, so that the service stays available and affordable for everyone.
4. Your content
Your photos, plant names, notes and messages remain yours. To run the features you ask for, you give us permission to store that content and to transmit it to the providers who process it — a photo you submit for identification goes to Plant.id, and a message you send to Sprout goes to Anthropic. That permission exists only to operate the app for you; we do not use your content for advertising, and we do not sell it. It ends when you delete the content or your account. The privacy policy sets out the detail.
You confirm that you have the right to upload whatever you upload.
5. Identification and AI advice are informational only
This is the most important section in these terms. Please read it.
Do not rely on NeroPlant for safety decisions
Plant identification, health diagnosis, toxicity information and everything the Sprout assistant says are informational and are not a guarantee. They are produced automatically, they are sometimes wrong, and two similar-looking plants can be confused — including plants that are edible and plants that are poisonous.
Never rely on NeroPlant when deciding whether to eat, taste, brew, apply or otherwise consume any plant, or whether a plant is safe around children, pets or livestock. Foraging and identifying wild plants for consumption is outside what this app is for.
If someone has eaten a plant, or a child or animal may have been poisoned, do not consult this app: contact your local poison control centre, a doctor or a vet, or your emergency services immediately.
NeroPlant does not give medical, veterinary, botanical, horticultural or professional advice of any kind, and using it does not create a professional relationship. For anything that matters — a valuable plant, an allergy, a suspected poisoning, a legal restriction on a species — consult a qualified professional. Care schedules and recommendations are general guidance; your own conditions of light, humidity, soil and climate matter more than any default we suggest, and we cannot guarantee that following the app will keep a plant alive.
6. Availability and changes
We aim to keep NeroPlant running, but we do not promise it will be uninterrupted or error-free. We may change, suspend or discontinue features — including features supplied by third parties such as identification or the assistant — and we may have to take the service down for maintenance. Some features depend on services we do not control and may be unavailable, rate-limited or degraded through no fault of ours; the app is designed to keep working, with reduced capability, when that happens.
7. Third-party services
NeroPlant uses Plant.id for identification and health assessment, Anthropic for the Sprout assistant, and Google for optional Google sign-in. Their processing is governed by their own terms and privacy policies. The app is also distributed through Google Play, whose terms apply to the download itself. We are not responsible for those services’ own acts or omissions.
8. No warranties
NeroPlant is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, non-infringement, and any warranty that identifications, diagnoses, toxicity information or care advice are accurate, complete or reliable.
9. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits, goodwill or opportunity, arising from your use of NeroPlant. In particular, and without limiting the above, we are not liable for damage to, illness of, or the death of any plant, nor for any loss arising from a wrong identification, a wrong diagnosis, wrong toxicity information or any advice given by the Sprout assistant.
Where liability cannot lawfully be excluded, our total liability to you for all claims relating to NeroPlant is limited to the greater of the amount you have paid us for the app in the twelve months before the claim (which, while the app is free, is nothing) or the equivalent of 50 US dollars.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded by law. If you are a consumer, you keep all the statutory rights your local law gives you, and these terms do not affect them.
10. Ending it
You can stop using NeroPlant at any time, and you can delete your account and all its data from inside the app — Profile → Delete account, as described on the account deletion page. Deletion is immediate and cannot be undone.
We may suspend or terminate an account that breaches these terms, that is being used to harm other users or the service, or where we are required to by law. If we discontinue NeroPlant altogether, we will give reasonable notice where we can so that you have a chance to save what matters to you.
11. Changes to these terms
We may update these terms as the app changes. The “last updated” date at the top will change, and where a change materially affects your rights we will make it visible in the app before it takes effect. Continuing to use NeroPlant after that means you accept the new terms; if you do not, delete your account.
12. Governing law
These terms and any dispute arising from them are governed by the laws of the country in which the operator of NeroPlant is established, and the courts of that country have jurisdiction — except that if you are a consumer, you may also bring proceedings in the courts of the country where you live, and you keep the protection of that country’s mandatory consumer law.
13. General
If any part of these terms is found unenforceable, the rest continues to apply. Our not enforcing a term is not a waiver of it. You may not transfer your rights under these terms; we may transfer ours to a successor of the app, on notice. These terms, together with the privacy policy, are the whole agreement between us about NeroPlant.
